By accessing and using the services of EIVUS Data Center (“EIVUS”, “we”, “our”), you agree to comply with these Terms of Service and all applicable laws. If you do not agree, you should discontinue use immediately.
2. Services Provided
EIVUS provides Virtual Private Servers (VPS), Bare Metal servers, network and related services. All services are subject to availability and may be modified, suspended, or discontinued at our sole discretion.
3. Eligibility
You must be at least 18 years old or the legal age in your jurisdiction to contract services with EIVUS. By signing up, you represent and warrant that you have the legal authority to enter into this agreement.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account, login, and password, and for all activities that occur under your account. EIVUS is not liable for losses due to unauthorized access if you fail to secure your credentials.
5. Acceptable Use Policy
- You may not use the services for illegal activities, spamming, phishing, malware, or abusive content.
- You may not attempt to disrupt, overload, or gain unauthorized access to systems or networks.
- You are responsible for the content and legality of all data hosted on our infrastructure.
6. Billing and Payments
All fees are due in advance according to your plan. Failure to pay may result in suspension or termination of services. Prices may be updated with prior notice.
7. Suspension and Termination
We reserve the right to suspend or terminate your account, without refund, if you breach these Terms, misuse the services, or if required by law.
8. Limitation of Liability
EIVUS is not liable for indirect, incidental, or consequential damages, including data loss, service interruption, or loss of profits. Our liability is limited to the amount paid by you for the services in the last 30 days.
9. Indemnification
You agree to indemnify and hold harmless EIVUS, its affiliates, and employees from any claims, damages, liabilities, or expenses arising from your use of the services.
10. Privacy
Our handling of personal data is governed by our Privacy Policy, available at Privacy Policy.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved exclusively in the courts located in Delaware.
12. Changes to Terms
We may update these Terms at any time. Continued use of the services after changes constitutes acceptance of the new Terms.
